1. AAMD Web Site Usage
   
   As a condition of your use of the Site, you represent and warrant to AAMD that you will not use the Site for any unlawful purpose or in any manner prohibited by this Terms of Use. You represent and warrant that you will not use the Site in any manner which could damage, disable, overburden or impair the Site or interfere with any other party's use and enjoyment of the Site.
   
   The Members Only portion of the Site ("Members' Site") will be accessible only to dues paying members of AAMD ("Members"). Members are responsible to input and update their Member information posted on the Site so that it is reasonably current, accurate and complete. If AAMD at any time discovers any error or omission in the information you provide, AAMD may, in its sole discretion, terminate the right to access and use the Members' Site by any Member. You may not permit anyone other than yourself to use your AAMD Member information to access any portions of the Site which are restricted to Members only, and you are responsible for the acts or omissions by third parties who are under your control for their use of the Members' Site, and for any damages incurred by you as a result thereof.
   
   The Members' Site may contain chat areas, forums, news groups, bulletin board services and other facilities ("AAMD Web Services") that permit you to communicate with other Members of AAMD. You agree to use these AAMD Web Services only to post, send and receive messages and materials that are appropriate and related to the facility or service. By way of example, and not as a limitation, you agree that when using AAMD Web Services, you will not:
   1. Violate any applicable laws or regulations;
   2. Upload information that contains material protected by intellectual property laws, including without limitation material protected by patent, copyright, trademark, or trade secrets, or by rights of privacy of publicity unless you own or control the rights thereto or have received all necessary consents;
   3. Falsify or delete author attributions, legal or other proper notices or proprietary designations indicating the origin or source of information that is uploaded or downloaded from the Site;
   4. Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information. Inappropriate topics, names, material or information may include without limitation, personal, non-topic related, criticisms or attacks, confrontational speech such as "flaming" or all caps posts, jokes, resumes, personal material and patient protected data;
   5. Harass, abuse, threaten or otherwise violate any legal rights of others;
   6. Upload viruses, corrupted files or any other software or information that may damage the operation of another's computer or network;
   7. Use the Site for commercial purposes, including, but not limited to, advertisements, promotions, offers to buy or sell goods or services, surveys, contests, pyramid schemes, or sponsorship banners;
   8. Use the Site to forward chain letters;
   9. Permit anyone other than yourself to use your AAMD Member information to access any portions of the Site which are restricted to Members only, including the Members' Site;
   10. Use any name other than your professional Member name, including without limitation nicknames or impersonations;
   11. Forward any material or information contained in one of AAMD's Web Services to anyone who is not a Member of AAMD; or
   12. Violate any of AAMD's policies, guidelines or other codes of conduct which are applicable to the Site or in particular to one of AAMD's Web Services;
   
   Unless prior written individual authorization is obtained, you agree to not use or disclose on AAMD's Web Site, including without limitation on AAMD's Web Services, any health information that identifies, or with respect to which a reasonable basis exists to believe that the information can be used to identify, an individual.
   
   AAMD has no obligation to screen or monitor AAMD's Web Services; however, AAMD reserves the right to review information or materials posted to any of AAMD's Web Services and to remove any such information or materials in its sole discretion. AAMD reserves the right at all times, in its sole discretion, to edit, refuse to post or to remove any information or materials from the Site, including without limitation to AAMD's Web Services, regardless of whether such material does or does not violate this Agreement or any AAMD policies, guidelines, or other codes of conduct which are applicable to the Site or in particular to one of AAMD's Web Services.
   
   AAMD does not control or endorse the content, messages or information found in any of AAMD's Web Services, and AAMD specifically disclaims any liability with regard to AAMD's Web Services such as areas related to forums or member submitted information. AAMD does not endorse or otherwise verify the accuracy, truthfulness or reliability of any information provided on AAMD's Web Services unless it is provided by an authorized AAMD spokesperson. Any statements made on AAMD's Web Services reflect only the views of their authors, and your reliance on any such content is at your own risk. AAMD's Web Services will be managed or hosted by either employees or Members of AAMD, who are not authorized AAMD spokespersons, and their views or actions in managing or hosting AAMD's Web Services do not necessarily reflect those of AAMD.
   
   AAMD reserves the right to pursue legal action against anyone performing illegal activities that include but are not limited to abuse and uploading of viruses. Usage of this Site indicates acknowledgement and acceptance of these terms.
   
   
2. Third Party Content
   
   AAMD is a distributor and not a publisher of content supplied by third parties and has no more editorial control over that content than a public library or a newsstand. AAMD is not responsible for any opinions, advice, statements, services or other information that constitutes Content and is provided by third parties. American Association of Medical Dosimetrists trademarks and trade dress may not be used in connection with any product or service that is not American Association of Medical Dosimetrists', in any manner that is likely to cause confusion among customers or in any manner that disparages or discredits American Association of Medical Dosimetrists. All other trademarks not owned by American Association of Medical Dosimetrists that appear on this site or through links to other sites are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by American Association of Medical Dosimetrists. These rights are valid and protected in all forms, media and technologies existing now or hereafter developed.
   
   
4. Disclaimer of Warranties; Limitation of Liability

AAMD, its representatives, and its licensors do not warrant that the content is accurate, reliable, or correct; that the site will be available at any particular time or location; that any defects or errors or that the content is free of viruses or other harmful components; your use of the site is solely at your risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.
   
   Under no circumstances shall AAM, its representatives, or its licensors be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of or inability to use, the site.    The Members Only Site is intended by AAMD to require a user ID and password to access and use. Certain AAMD Web Services may require additional codes. You are solely responsible for (1) maintaining the strict confidentiality of the user IDs, passwords and codes ("Member Information") assigned to you; (2) charges, damages or losses that may be incurred or suffered as a result of your or your personnel's failure to maintain the strict confidentiality of Member Information; and (3) promptly informing AAMD in writing of any need to deactivate and replace any Member Information due to security concerns. AAMD is not liable for any harm related to the theft of your Member Information, your disclosure of your Member Information, or your authorization to allow another person or entity to access and use the Members Only Site using your Member Information. You agree to notify AAMD immediately as soon as you become aware of any unauthorized use of your Member Information. Notice to AAMD under this section may be sent by mail or email at the address set forth in Section 11 below.
